In the evolving landscape of legal services, regulations prohibiting the unauthorized practice of law (UPL) have long served to protect consumers by ensuring that only qualified individuals provide legal representation. With the emergence of generative artificial intelligence, we’ve seen an explosion of innovation with the potential to enhance access to justice. At what point does this innovation cross the line into legal representation? How can we balance the need for innovation that allows more people to receive the legal assistance they need with the need to protect those same consumers? In his recent article “Re-Regulating UPL in an Age of AI,” 8 Georgetown Law Technology Review 316 (2024), Professor Ed Walters explores this question, providing a possible framework for this balancing act.
