Noel Francisco, ’96, Argues for ByteDance, TikTok Before Supreme Court

A group of experienced practitioners is arguing before the justices today.

The lawyers arguing before the Supreme Court on Friday are well known among the elite cadre of practitioners who regularly appear before the nation’s highest bench.

Two of the lawyers are challenging the law as unconstitutional, saying it violates the First Amendment rights of both TikTok and its users. They come from opposite ideological backgrounds.

The first, Noel J. Francisco, who represents ByteDance, is a prominent conservative litigator who is now a partner at the Jones Day law firm. A graduate of the University of Chicago Law School, Mr. Francisco clerked for Justice Antonin Scalia and served in the White House and the Justice Department in the George W. Bush administration.
