In response, President Richard Nixon railed against Warren Court during his presidential campaign in 1968. “It often seemed during that time that Nixon was running against the Supreme Court as much as he was running against the Democratic nominee,” said Driver.

He said if the court does become solidly conservative, it could drive liberal politicians to adopt the tactics of Roosevelt and Nixon.

“These are two instances where … leaders, political leaders, are using the Supreme Court as a foil,” said Driver. “And one could imagine Democrats using the Supreme Court as a foil with politics in the future.”
