Professor Helland and Professor Hubbard will discuss what the insurance industry calls “mass compensation events”—everything from the opioid crisis to the BP oil spill. They will analyze the tradeoffs between using a class action, a multidistrict litigation (MDL), a no-fault system, or private compensation funds (similar to the 9-11 victims' compensation fund). Then, they will connect it to some of the lessons we can learn from products liability litigation.
